Florida Vacation Rental Laws 2026: State Preemption, DBPR Licensing, Local Rules, and HOA Restrictions

Florida is one of the most active vacation rental markets in the US โ€” with over 600,000 short-term rental units across the state. But the legal landscape for short-term rentals (STRs) in Florida is layered and has shifted multiple times in recent years. State law, county ordinances, city regulations, and HOA documents all independently govern whether you can rent a property on Airbnb or Vrbo โ€” and the rules aren't always consistent. Before buying a Florida investment property with STR intentions, understanding each layer is essential.

Florida's State Preemption Statute โ€” The Foundation

Florida Statute ยง 509.032(7) โ€” commonly called the vacation rental preemption statute โ€” limits municipalities' ability to ban vacation rentals entirely. The law has been amended multiple times (2011, 2014, 2021, 2024) and the current framework generally:

HOA and Condo Association Restrictions

This is the layer that catches most investors off guard. Florida state preemption governs government regulation โ€” it does NOT prevent private HOAs and condo associations from restricting or banning STRs through their governing documents (Declaration of Covenants, Conditions, and Restrictions โ€” CC&Rs).

Due diligence before buying: Request the full HOA/condo declaration, bylaws, and rules & regulations. Specifically search for "lease," "rental," "tenant," "short-term," and "transient" in the documents. If ambiguous, get a legal opinion before closing. Changing HOA documents requires a supermajority vote โ€” you cannot count on future reform.
